Introduction

This Privacy Policy ("Policy") explains in general terms how Res4 ("Res4", "we" "our" or "us") protects the privacy of your personal information. We are firmly committed to protecting the privacy and confidentiality of personal information and maintain robust physical, electronic and procedural safeguards to protect personal information in our care.

What is personal information?

Personal information is information or an opinion, in any form (whether true or not) about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.

How do we collect personal information?

Where practical we will collect personal information directly from you. Generally this will be collected by us when you deal with us either in person, by telephone, letter, facsimile, email or when you visit our website. We may request information about you when you purchase or make enquires about tickets or other products and services; when you enter competitions, register for promotions or when you request brochures or other information. We may also collect information when we invite you to complete surveys or provide us with feedback.

What personal information do we collect?

Generally, the type of personal information we collect about you is the information that is needed to facilitate your travel arrangements and bookings and to provide travel services and products to you. For example, we may collect details such as your name, mailing address, telephone number, email address, passport details, dietary requirements (if any) and health issues relevant to your travel arrangements. We, however, DO NOT collect financial details like credit card number, expiry date, etc …

We are required by law to obtain your consent to the collection of sensitive information. We will assume that you have consented to the collection of all information which is provided to us for use in accordance with this Policy, unless you tell us otherwise.

When we act as agent

When we sell products and services to you, we usually do so as agent for the wholesaler or provider of those products and services. This means that we usually collect personal information about you, both for our internal purposes, and on behalf of the parties for whom we act as agent, for their internal purposes. Accordingly, the consent you provide under this statement to the collection of personal information by us, applies equally to the parties whose products and services we sell. For example, if you purchase an Air India flight from us, then under this policy you will have consented to your personal information being used by us, being provided to Air India to enable your flight to be booked and being used by Air India for Air India’s purposes.

How do we use personal information?

We will use your personal information to provide you with travel and travel related products and services.

We may use and disclose your personal information for the purposes for which it was collected, or for a related or ancillary purpose such as any one or more of the following purposes:

  • Identification of fraud or error;
  • Regulatory reporting and compliance;
  • Developing, improving and marketing our products and services;
  • Servicing our relationship with you by, among other things, providing updates on promotions and services we think may interest you;
  • Involving you in market research gauging customer satisfaction and seeking feedback regarding our relationship with you;
  • To facilitate your participation in loyalty programs;
  • To analyze trends in sales and travel destinations;
  • For marketing activities; and
  • Internal accounting and administration.

Is the information disclosed to third parties?

  • to third parties for the purpose of analyzing trends in sales and travel destinations.

The third parties to whom we disclose your personal information may also be taken to have collected your personal information in their own right, for their internal use. For more information, see the heading above, titled "When we act as agent".

Where we engage third party contractors to perform services for us those third party contractors may be required to handle your personal information. Under these circumstances those third party contractors must safeguard this information and must only use it for the purposes for which it was supplied, although we are not responsible for ensuring this.

Other than the above, we will not disclose your personal information without your consent unless disclosure is either necessary to prevent a threat to life or health, authorized or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.

Trans-Border data flows

In providing our services to you it may be necessary for us to forward personal information to relevant overseas third party service providers. Please let us know if you have any objections to such transfers.

Res4 has implemented appropriate physical, electronic and managerial security procedures in order to protect personal information from loss, misuse, alteration or destruction.

Res4 regularly reviews security and encryption technologies and will strive to protect information to the fullest extent possible.

A cookie is a small piece of text that is placed within the memory of a computer and can be later retrieved by web page servers. We use cookies to enhance your interaction and convenience with our website and do not use cookies to record any personal information.

This website at www.Res4.com (the "Site") is owned and operated by Amco Travels Pvt. Ltd. ("Res4", "we", "us") and is governed by the laws of India. This page sets out the Terms and Conditions under which you may use this Site (the "Terms"). Please read the Terms carefully. If you do not accept the Terms stated here, do not use this Site and service. By using this Site, you are indicating your acceptance to be bound by these Terms. The term "you" as used in these Terms refers to all individuals and/or entities accessing this Site for any reason.

1. Website information

  • This Site displays information about travel locations, airfares, travel agents locations, flight times and dates, tours, packages, insurance, cruises, transportation, foreign currency, schedules, travel companies, information about Res4 and many other things.
  • Most of this information is supplied to us by third party providers including airlines, hotels and transportation suppliers. Therefore, although we have taken reasonable care to ensure that this information is correct and up to date, we cannot check the accuracy of such information where it is provided to us by third parties.
  • We accept no responsibility for information supplied to us by third parties. We recommend you confirm all information contained on or linked from the Site with the relevant third party provider.

2. Prices, Travel Restrictions and Conditions

  • Restrictions and conditions apply to all of the travel products and services offered on this Site and such restrictions and conditions may affect the prices set out on the Site. To determine the applicable restrictions and conditions you must contact us or the relevant third party provider.
  • The airlines and other third party providers of travel and travel related services may change their prices, details of their packages, tours, flights and other information displayed on the Site at any time. For this reason, all prices displayed on the Site are subject to change without notice. All travel products and services described on the Site are subject to availability.
  • We will endeavor to notify you of all relevant taxes, airport charges and any other additional costs when you confirm your booking with us (as at that date) but these may be subject to variation prior to your departure.
  • You are responsible for obtaining all passport, visa and health information that you may require. We may assist you to obtain such information, however the final responsibility for obtaining the necessary information and complying with any passport, visa and health requirement remains with you.

3. Intellectual Property

  • The material contained on this Site, including (without limitation) the software, design, text and graphics (including trademarks) comprised in this Site and the selection and layout of this Site, are owned or licensed by us and are protected by Indian and international intellectual property laws, including copyright.

  • At all times we retain the right to monitor, retain and disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.
  • We may disclose aggregated information about users and use statistics relating to the Site and aggregated information about our sales and trading patterns to others.

8. Disclaimers and Limitation of Liability

You release us from any claims in relation to the travel products and services described on the Site, including but not limited to claims that the travel products and services are not suitable.
  • The travel products and services offered and promoted via the Site are products and services of third parties. Our role is to facilitate your travel arrangements, including processing your bookings and making payments. We are acting as an agent for third party providers. Your legal relationship in respect of the third party products and services is with the relevant third party provider.
  • If any warranties are implied by law that cannot be excluded, then our liability for breach of such warranties is limited, at our option, to:
    • in the case of products:
      • the replacement of the products or the supply of equivalent products;
      • the payment of the cost of replacing the products or acquiring equivalent products;
    • in the case of services:
      • the supply of the services again;
      • the payment of the cost of having the services supplied again.

9. Linking

  • We may link our Site to other sites on the World Wide Web. We are not required to maintain or update these links. These links are provided for your convenience only. It does not mean that we have reviewed these sites or that we endorse them. We are not responsible for the content of other sites, even if we link to them and we are not recommending these sites or their products or services to you.
  • We make no warranties and accept no liability if you suffer any loss or damage in relation to material contained on external sites or using another's product or services.

10. Security

  • The online booking facilities of our third party providers utilize Secure Sockets Layer (SSL) encryption to ensure the security of all online booking transactions. SSL encryption is automatically enabled whenever the user submits confidential information to us via the Internet.
  • Within Res4 online booking facilities the transmission of credit card information towards the booking is done by the user directly over the bank’s payment gateway and we do not have any record or control over such transaction or transmission..

  • A cookie is a small piece of text that is placed within the memory of a computer and can be later retrieved by web page servers. We use cookies to enhance your interaction and convenience with our website and do not use cookies to record any personal information.

No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended to be created between you and us by these Terms.

15. Notices

Except as required by law or otherwise specified by us, you must provide any notices to us. provide any notices to you by email to any email address provided by you. Notices will be taken to have been received 24 hours after the email is sent, unless the sending party receives notice that the address is invalid or that the email has not been received.

16. Governing law

  • If any dispute arises about this agreement or how this agreement applies or arising out of your use of this Site, the laws of the city of Mumbai within the state of Maharashtra and in the country, INDIA will apply.
  • You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Mumbai, Maharashtra, INDIA and waive any right that you may have to object to an action being brought in those courts.

17. General

  • If any of these Terms are invalid or unenforceable, it will be struck out, and the remaining Terms will remain in force.
  • Headings are for reference purposes only.
  • If we do not act in relation to a breach by you or others of these Terms, this does not waive our right to act with respect to subsequent or similar breaches.
  • In these Terms, the term "Site" includes any email bulletins or other content that we provide to you via or initiated from this Site.

BOOKING TERMS AND CONDITIONS

Please read the following terms and conditions carefully. You must not accept any booking unless you understand and agree with the following terms and conditions.

Prices:

All prices are subject to availability and can be withdrawn or varied without notice.

Travel Documents:

Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. All travel documents are non transferable. All airline tickets must be issued in the name of the passport/photo identity holder, some carriers will deny carriage if the name varies and the booking may be cancelled. It is your responsibility to collect all travel documents from us prior to travel. Please contact your consultant the day before collection to confirm that the travel documents are ready for collection.

Schedule Changes:

It is your responsibility to contact the airline prior to travel to ensure the scheduled departure time has not changed.

Travel Insurance:

We can provide information to you about travel insurance. For details of the services we provide, including a quote, please refer to our Financial Services Guide. Travel insurance is strongly recommended by the Department of Foreign Affairs and Trade for all overseas travel.

Passports & Visas:

It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. All travelers must have a valid passport for international travel and many countries require at least 6 months validity from the date of entry. If you need information regarding visa and other travel document requirements for your trip please let us know. We can obtain such information from an external visa advisory service provider on your behalf. We do not warrant the accuracy of such information and accept no liability for any loss or damage, which you may suffer in reliance on it. We can obtain visas for you if you wish and fees may apply for this service.

Carry-on Baggage at International Airports:

To increase your safety, there are new rules for taking liquids, aerosols and gels on flights worldwide. These new rules are needed to protect you from the threat of liquid explosives, so please ensure you check with the visiting country embassy airline office prior to your travel.

Health:

It is your responsibility to ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation.

Taxes:

Certain taxes are mandatory in various countries. There may also be an additional local tax charged at some airports. All taxes are subject to change without notice.

Cancellation Fees:

We are unable to provide a refund to you until we receive the funds from the relevant supplier.Cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Fees will also apply where a booking is changed or tickets are reissued.

Agency:

Res4 acts as a travel agent only. We sell various travel related products on behalf of numerous transports, accommodation and other wholesale service providers, such as airlines, coach, rail and cruise line operators.  Res4 obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider and not Res4. If for any reason, any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with Res4.

Liability:

We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control which is not preventable by reasonable diligence on our part.

Credit Card Transactions:

Credit card surcharges may apply when paying by credit card. If for any reason any travel service provider is unable to provide the services for which you have contracted, your remedy lies against that provider, and not against Res4. In the event that payment has been made to Res4 by credit card, you agree that you will not seek to charge back your payment to Res4.
